We are providing you with access to this Site, website application (“Web App”) and mobile application (“Mobile App”) (together, Our “Services”) as described on our Site and subject to the following terms and conditions.

By browsing, accessing, using or registering on this Site or otherwise using Our Services, you are agreeing to all of the following terms and conditions, including any policies referred to herein (collectively, these “Terms”). So, please read these Terms carefully. We reserve the right to change this Site and these Terms at any time. If you are unwilling to be bound by these Terms‚ you should not browse, access‚ use or register into our Site.

You represent and warrant that you are at least 16 years old or visiting this Site under the supervision of a parent or guardian.

1. USE LICENSE

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Kickresume's Services for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

2. ACCOUNT

In order to access some features of Our Services‚ you may be required to register and We may assign to you, or you may be required to select, a password and user name or account identification. If you register‚ you agree to provide Us with accurate and complete registration information‚ and to inform Us immediately of any updates or other changes to such information.

You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You shall immediately notify Us of any unauthorized use of your password or identification or any other breach or threatened breach of this Site's security. Each time you use a password or identification, you will be deemed to be authorized to access and use Our Services in a manner consistent with these Terms, and We have no obligation to investigate the authorization or source of any such access or use of this Site.

YOU WILL BE SOLELY RESPONSIBLE FOR ALL ACCESS TO AND USE OF OUR SERVICES BY ANYONE USING THE PASSWORD AND IDENTIFICATION ORIGINALLY SELECTED BY, OR ASSIGNED TO, YOU WHETHER OR NOT SUCH ACCESS TO AND USE OF OUR SERVICES IS ACTUALLY AUTHORIZED BY YOU, INCLUDING WITHOUT LIMITATION, ALL COMMUNICATIONS AND TRANSMISSIONS AND ALL OBLIGATIONS (INCLUDING WITHOUT LIMITATION FINANCIAL OBLIGATIONS) INCURRED THROUGH SUCH ACCESS OR USE.

3. DISCLAIMER

The materials on Kickresume's Services are provided 'as is'. Kickresume makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Kickresume does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Services or otherwise relating to such materials or on any sites linked to its Services.

4. LIMITATIONS

In no event shall Kickresume or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Kickresume's Services or Kickresume´s Services, even if Kickresume or a Kickresume authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. REVISIONS AND ERRATA

The materials appearing on Kickresume's Services could include technical, typographical, or photographic errors. Kickresume does not warrant that any of the materials on its Services are accurate, complete, or current. Kickresume may make changes to the materials contained on its Services at any time without notice. Kickresume does not, however, make any commitment to update the materials.

6. BUSINESS PARTNERS

Kickresume has contractual business partners (partner employers, job recruitment agencies) using business services of Kickresume allowing them to find prospective employees tailored to their needs. Based on criteria entered into Our system, the contractual business partners are provided with the list of resumes and cover letters of suitable potential employees (our users) if our users grant consent to us to provide their personal data to our business partner (for more information, please, see our Privacy Policy). In the event of their interest in some user they may contact him/her directly through contact details provided in the user´s resume and/or cover letter.

You, as Our user, may decide if you wish to include your resume and/or cover letter (created through Our Site) into the database through which Our system selects suitable employees for Our business partners. You may agree by giving your consent to it during a registration process on Our Site. We thus provide the business partners with your resume and cover letter only on the basis of your explicit consent granted during the registration process or later. Please read more about your rights related to the consent in Our Privacy Policy.

Kickresume is in the position of an intermediary in relation to any legal relationship established between Our business partner and Our user thanks to the service provided to Our business partners and has no liability resulting from such legal relationship.

7. LINKS

Kickresume has not reviewed all of the websites linked to its Services and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Kickresume of the site. Use of any such linked website is at the user's own risk.

8. GOVERNING LAW

Any claim relating to Kickresume's Services shall be governed by the laws of the Slovak Republic without regard to its conflict of law provisions.

9. INTELLECTUAL PROPERTY

For purposes of these Terms and Privacy Policy, 'content' is defined as any information, data, communications, software, photos, video, graphics, music, sounds, and other material and services that can be viewed by users on Our site. By accepting these Terms and Privacy Policy, you acknowledge and agree that all content presented to you on Our Services is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws, and is the sole property of Kickresume. You are only permitted to use the content as expressly authorized by us. Except for a single copy made for personal use only, you may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any documents or information from Our Services in any form or by any means without prior written permission from us, and you are solely responsible for obtaining permission before reusing any copyrighted material that is available on this site. Any unauthorized use of the materials appearing on Our Services may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

11. FEEDBACK

Separate and apart from user content, you may have the ability to submit questions, comments suggestions, reviews, ideas, plans, designs, notes, proposals, drawings, original or creative materials and other information regarding this Site, Us and Our products or services (collectively "Feedback"). You agree that Feedback is non-confidential and shall become Our sole property. We shall own exclusive rights, including all intellectual property rights, in and to such Feedback and shall be entitled to the unrestricted use and dissemination of the Feedback for any purpose, commercial or otherwise, without acknowledgement or compensation to you. Your personal data provided for the Feedback purposes is processed in compliance with our Privacy Policy.

12. GENERAL TERMS AND CONDITIONS FOR ALL SUBSCRIPTIONS

Subscriptions and one-off services are non-returnable. You may cancel your subscription, but no refunds will be paid on any remaining subscription period. An internet connection is required to use and manage your subscription basis. Without an internet connection, your software may stop running. Subscription pricing is subject to change. New pricing takes effect upon the renewal of your subscription. Web App subscriptions, namely monthly, quarterly and annual, already include a Mobile App subscription for a corresponding period of time, as long as the Web App subscription is paid for. The annual Mobile App subscription does not include a Web App Premium subscription of any kind.

By upgrading to a chosen Subscription you grant us an explicit consent with using the Services before expiry of the 14- day withdrawal period (please see Article 21 Termination) and declare that you have been informed that your right to withdraw from the Subscription within the above 14-day period cannot be exercised (please see Article 21 Termination).

Irrespective of the above, if you are a new user first attempting to use our Services within Subscription, We may provide you with a 14-day money back guarantee. The 14-day money back guarantee applies only once to the same user. If you subsequently intend to engage in another Subscription, you will not be entitled to another 14-day money back guarantee.  

13. MONTHLY SUBSCRIPTION

Monthly subscriptions are available for Our Website App, at the price indicated on Our Site. Your monthly subscription for Kickresume will start after receiving your payment and will continue for a period of thirty days. When you purchase a monthly subscription, auto-renew is automatically selected in your account. At the end of the monthly subscription period, you will automatically be signed up and billed for an additional subscription term of 30 days. If you do not wish to renew your subscription, you have to cancel it prior to the end of your current subscription term. You will remain on Kickresume subscription until the last paid for period expires.

14. QUARTERLY SUBSCRIPTION

Quarterly subscriptions are available for Our Website App, at the price indicated on Our Site. Your quarterly subscription for Kickresume will start after receiving your payment and will continue for a period of ninety days. When you purchase a quarterly subscription, auto-renew is automatically selected in your account. At the end of the quarterly subscription period, you will automatically be signed up and billed for an additional subscription term of 90 days. If you do not wish to renew your subscription, you have to cancel it prior to the end of your current subscription term. You will remain on Kickresume subscription until the last paid for period expires.

15. ANNUAL SUBSCRIPTION

Annual subscriptions are available for Our Web App, at the price indicated on Our Site, and Mobile App at the price indicated in Our Mobile App. Your annual subscription for Kickresume Web App will start upon receiving your payment and will continue for a period of one year. Annual subscriptions are paid in full in advance. When you purchase an annual subscription, auto-renew is automatically selected in your account. At the end of the annual subscription period, Kickresume will sign you up and bill you for an additional subscription term of one year. If you do not wish to renew your subscription, you have to cancel it prior to the end of your current subscription term. You will remain on Kickresume subscription until the last paid for period expires.

16. ONE-OFF FEES

One-off services, such as proofreading, are available in the Web App and Mobile App. The Kickresume one-off service will start after We receive your payment.

Only valid credit cards or other payment method acceptable to Us may be used. By submitting your order, you represent and warrant that you are authorized to use the designated card or method and authorize Us to charge your order (including taxes, credit card fees, any other amounts described on the Sites) to that card or other method. If the card (or other method) cannot be verified, is invalid, or is not otherwise acceptable, your order may be suspended or cancelled automatically.

17. PAYMENT OF FEES

Our prices for a Subscription do not include any of the third-party fees you incur in connection with using a Paid Service including, without limitation, fees charged by your Internet access provider, any wireless carrier charges for cellular or data services and any other third party applications or services with which you may use the Paid Service; you are responsible for selecting and managing these other services, and paying the fees for such services.

18. CHANGES IN FEES

We may change the price of any Subscription from time to time, and add new fees and charges for certain features or to reflect a change in business or legal rules, but We will provide you with advance notice of changes in recurring subscription fees. Any increase in charges for the same Subscription would not apply until the expiration of your then current billing cycle, unless otherwise specifically provided in Our notice, and would become effective no sooner than the next time you would be charged for that Subscription. If you do not agree to pay the new price or other applicable charges, you may decide not to renew the Subscription before the price change goes into effect, which cancellation would be effective at the expiration of your then current billing cycle.

19. AUTORENEWAL

We accept debit and credit cards as well as other forms of payment (e.g., Paypal transfers) as payment methods for Subscriptions. Payment Methods may vary by country and may change from time to time. When you purchase the Subscription, the fees will be billed on or near the date of your purchase. If you purchase a Subscription that renews automatically, such as monthly or annually, you agree that We may process your payment on each monthly, annual or other renewal term (based on the billing cycle), on or near the calendar day corresponding to the commencement of your Subscription, as applicable. In addition, you agree that We have permission to retain and/or share with financial institutions and payment processing firms (including any institutions or firms We retain in the future) information regarding your purchase and your submitted payment information in order to process your purchase, and to use the email address submitted by you to provide you with notices and disclosures relating to renewals and recurring charges. If your Subscription began on a day not contained in a subsequent month (e.g., your service began on January 30, and there is no February 30), Kickresume will process your payment on or near the last day of such month.

We attempt to be as accurate as possible and eliminate errors on this Site; however, We do not warrant that any product, service, description, photograph, pricing or other information is accurate, complete, reliable, current or error-free. In the event of an error, whether on this Site, in an order confirmation, in processing an order, delivering a product or service or otherwise, We reserve the right to correct such error and revise your order accordingly if necessary (including charging the correct price) or to cancel the order and refund any amount charged. Your sole remedy in the event of such error is to cancel your order and obtain a refund.

20. COMMUNICATIONS

When you use this Site, or send emails to Us, you are communicating with Us electronically. You consent to receive communications from Us electronically. We will communicate with you by e-mail or by posting notices on this Site or through Our other Services. You agree that all agreements, notices, disclosures and other communication that We provide to you electronically satisfy any legal requirements that such communications be in writing.

Based on our legitimate interest We may use your personal information to reach out to you with newsletters, marketing or promotional materials and other information that may be interesting for you. You can opt out of receiving any of these communications and advertisements from Kickresume (please see Our Privacy Policy for more details).

21. TERMINATION

You may terminate the Terms at any time by closing your account, discontinuing your use of Our Services (your account will be automatically cancelled after 5 years from your last log in) and providing Us with a notice of termination. We reserve the right, without notice and in Our sole discretion, to terminate your right to use this Site, or any portion of this Site, and to block or prevent your future access to and use of this Site or any portion of this Site. If We block your access to the Site without any reason you have a right to the refund of the proportional part of the subscription for a remaining subscription period.

If you close your account, your may renew your access within 30 days from such closing. After the 30 days your account and data will be erased.

You also have a right to withdraw from the chosen Subscription (the distance contract) within 14 days from the moment of conclusion of the contract (upgrade to the chosen Subscription). Please note that by granting a consent to commence the provision of the Services or by using the Services before the expiry of the withdrawal period, your right of withdrawal is lost once the Services have been fully provided.

22. NO THIRD-PARTY BENEFICIARIES

These Terms are for the benefit of, and will be enforceable by, the parties only. These Terms are not intended to confer any right or benefit on any third party or to create any obligations or liability of a party to any such third party.

23. MODIFICATIONS TO SITE

We reserve the right to modify or discontinue, temporarily or permanently, this Site or any features or portions thereof without prior notice.

24. SEVERABILITY

If any provision in these terms is held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity of the remaining provisions.

25. TERMINATION AND CHANGE

Kickresume may suspend or terminate the Kickresume Referral Program or a user’s ability to participate in the Kickresume Referral Program at any time for any reason.

We reserve the right to suspend accounts or remove provisions if We notice any activity that We believe is abusive or fraudulent. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals as deemed fair and appropriate. We reserve the right for future changes of provisions and discounts for Kickresume users.

26. UPDATES TO THE TERMS

We can update these terms at any time without prior notice. If We modify these terms, We will post the modification on the Kickresume.com website. Continued participation in the Referral Program after any modification shall constitute consent to such modifications and changes.
